1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your use of Styrotech Polystyrene Supply’s (“Styrotech,” “we,” “us,” or “our”) website and the purchase of products and services from us.
 
By accessing our website, requesting a quote, or purchasing our products, you agree to be bound by these Terms. If you do not agree, please do not use our services.

 

2. DEFINITIONS

  • “Customer,” “you,” “your” refers to the individual or entity purchasing products or services from Styrotech
  • “Products” refers to polystyrene materials and related goods supplied by Styrotech
  • “Services” refers to design support, custom cutting, machining, delivery, and related services
  • “Order” refers to a confirmed purchase of Products or Services

4. QUOTATIONS AND ORDERS

4.1 Quotations

  • All quotations are provided on a case-by-case basis and are valid for 7 days from the date of issue unless otherwise stated
  • Quotations are not binding until an Order is confirmed
  • Prices in quotations are subject to change based on material costs, specifications, and other factors
  • Quotations are based on the information provided by the Customer. Changes to specifications may result in revised pricing
 

4.2 Order Acceptance

  • An Order is only confirmed when we provide written acceptance (via email or other written communication)
  • We reserve the right to refuse or cancel any Order at our discretion
  • If an Order is cancelled by us after acceptance, we will provide a full refund of any payments made
 

4.3 Order Modifications

  • Changes to confirmed Orders may be subject to additional charges and delays
  • Requests for modifications must be submitted in writing
  • We will assess modification requests and advise on feasibility, cost, and timing

5. PRICING AND PAYMENT

5.1 Pricing

  • All prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated
  • Prices include as specification in quote.
  • Delivery charges are additional and will be specified in the quotation
  • We reserve the right to adjust prices if there are significant changes in material costs, specifications, or other unforeseen circumstances
 

5.2 Payment Terms

  • Payment terms will be specified in the quotation and invoice
  • Standard payment terms: Payment on order.
  • Accepted payment methods: Bank transfer, credit card.
  • GST will be added to all invoices as required by law
 

5.3 Late Payment

  • Overdue accounts may be subject to interest charges and/or suspension of services
  • We reserve the right to charge interest on overdue amounts at 10% per month or the maximum rate permitted by law
  • We may engage debt collection services for significantly overdue accounts, and you will be responsible for any associated costs

6. PRODUCT SPECIFICATIONS

6.1 Custom Products

  • Products manufactured to custom specifications (profile cutting, machined foam) are based on information and designs provided by the Customer
  • The Customer is responsible for the accuracy and suitability of specifications, drawings, and designs
  • We provide design support but the Customer retains ultimate responsibility for ensuring products meet their project requirements
 

6.2 Tolerances

  • Standard tolerances apply unless otherwise agreed in writing
  • Polystyrene is a compressible material; typical tolerances are ±1-3mm for standard products
  • Tighter tolerances may be achievable for machined products but must be specified and agreed upon
 

6.3 Density and Material Specifications

  • Products are manufactured to Australian Standard AS1366.3 or as otherwise specified
  • Density grades are nominal; minor variations within industry standards are acceptable
  • Material properties meet or exceed minimum requirements for the specified grade

7. DELIVERY AND PICKUP

7.1 Delivery

  • Delivery is available Australia-wide
  • Delivery timeframes are estimates and not guaranteed unless expressly agreed in writing
  • Delivery costs are additional and specified in the quotation
  • The Customer is responsible for ensuring suitable access for delivery vehicles
  • Risk passes to the Customer upon delivery or when goods are made available for pickup
 

7.2 Pickup

  • Not available at this time.
 

7.3 Delays

  • We will make reasonable efforts to meet agreed delivery dates
  • We are not liable for delays caused by circumstances beyond our reasonable control (force majeure events, supplier delays, transport disruptions, etc.)
  • If delivery is delayed, we will notify the Customer as soon as reasonably practicable
  • The Customer acknowledges that delivery timeframes are estimates only and Styrotech is not liable for any losses arising from delivery delays
 

7.4 Non-Delivery

  • The Customer must inspect goods upon delivery
  • Any shortage or damage must be reported on the same day of delivery
  • We will not be liable for claims made after this period

8. TITLE AND RISK

8.1 Risk

  • Risk in the Products passes to the Customer upon delivery (or when made available for pickup)
  • The Customer is responsible for insurance from the point risk passes
 

8.2 Title

  • Title to the Products remains with Styrotech until full payment is received
  • Until payment is made in full, the Customer holds the Products as bailee and must store them separately and identifiably

9. RETURNS AND CANCELLATIONS

9.1 Custom Products

  • Custom-manufactured products (profile cut, machined foam, or made-to-specification) are non-returnable and non-refundable.

9.2 Standard Products

  • Standard Products are non-returnable and non-refundable.

9.3 Order Cancellation

  • Cancellation of Orders must be requested in writing
  • Cancellation of confirmed Orders may incur fees if materials have been procured or work has commenced
  • Custom products cannot be cancelled once production has begun

10. WARRANTIES AND LIABILITY

10.1 Product Warranty

  • We warrant that Products will:
    • Conform to agreed specifications
    • Be free from defects in materials and workmanship
    • Comply with Australian Standard AS1366.3 (where applicable)
  • This warranty is valid for 3 days from delivery
  • This warranty does not cover:
    • Damage caused by improper use, storage, or handling
    • Normal wear and tear
    • Modifications made by the Customer
    • Products used outside their intended application
  • Our total liability under this warranty is limited to replacement or refund of the defective Products only. We are not liable for any indirect, consequential, or incidental damages including but not limited to loss of profits, project delays, or costs of labor
 

10.2 Limitation of Liability

  • Our liability is limited to:
    • Replacement of defective Products 
    • Refund of the purchase price
    • Repair of defective Products (at our discretion)
  • We are not liable for:
    • Consequential or indirect losses (including lost profits, project delays, or business interruption)
    • Losses arising from the Customer’s use or application of Products all services
    • Defects caused by Customer-provided specifications or designs
 

10.3 Customer Responsibility

  • The Customer is responsible for:
    • Ensuring Products are suitable for their intended use
    • Compliance with all applicable building codes, regulations, and standards
    • Proper installation, storage, and handling of Products
    • Engaging qualified professionals for installation (where applicable)
 

10.4 Consumer Guarantees

  • Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other applicable laws
  • Our liability for breach of a consumer guarantee is limited to the extent permitted by law

11. INTELLECTUAL PROPERTY

11.1 Styrotech Proprietary Methods

All design work, manufacturing processes, methodologies, and technical data created by Styrotech remain the exclusive property of Styrotech (Elion Group Pty Ltd). This includes, but is not limited to:
  • Design files and technical documentation
  • Manufacturing methods and processes
  • Optimisation techniques
  • Any derivative works created from Customer specifications


11.2 Customer License

The Customer receives a license to use the physical products manufactured by Styrotech for their intended purpose. The Customer does not receive rights to:
  • Design files or technical documentation
  • Manufacturing processes or methods
  • Replication or reverse-engineering of designs
  • Transfer or sharing of Styrotech’s work product with third parties

11.3 Customer-Provided Materials

If the Customer provides specifications, sketches, or reference materials:
  • Customer retains ownership of materials provided
  • Customer grants Styrotech license to use these materials solely for fulfilling the Customer’s order
  • Styrotech’s design work based on Customer input remains Styrotech property
  • Information that is publicly available, common knowledge, or already known to Styrotech is not considered confidential and may be used by Styrotech for any purpose

11.4 Website & Marketing Content

All content on our website, including text, graphics, logos, and images, is the property of Styrotech or licensed to us. You may not reproduce, distribute, or use our content without prior written permission.
 

11.5 Use of Customer Information

By placing an order, the Customer acknowledges and agrees that:
  • Styrotech may share project specifications with third-party manufacturers, suppliers, and contractors as necessary to fulfill orders
  • Styrotech retains the right to use, modify, and adapt all designs, concepts, and specifications for any purpose, including work for other clients
  • Styrotech may use project details, images, and outcomes for marketing, portfolio, and promotional purposes without restriction

12. FORCE MAJEURE

We are not liable for failure to perform our obligations due to events beyond our reasonable control, including:
  • Natural disasters
  • Pandemics or health emergencies
  • Government actions or regulations
  • Labor disputes
  • Supplier failures
  • Transport disruptions
In such events, our obligations will be suspended for the duration of the force majeure event.

 

13. DISPUTE RESOLUTION

13.1 Negotiation

  • Any disputes will first be addressed through good faith negotiation between the parties
 

13.2 Governing Law

  • These Terms are governed by the laws of Queensland, Australia
  • Both parties submit to the exclusive jurisdiction of the courts of Queensland, Australia

14. GENERAL PROVISIONS

14.1 Entire Agreement

  • These Terms, together with any quotation or Order confirmation, constitute the entire agreement between the parties

     

14.2 Amendments

  • We may update these Terms from time to time
  • Updated Terms will be posted on our website with a revised date
  • Continued use of our services constitutes acceptance of updated Terms

     

14.3 Severability

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force

     

15.4 Waiver

  • Failure to enforce any provision does not constitute a waiver of that provision

     

14.5 Assignment

  • The Customer may not assign or transfer their rights under these Terms without our written consent
  • We may assign our rights to a third party
